Terms of Service

Faves is a free web app that helps people share what they love — restaurants, books, scents, places, all of it — with the people who care about them. You can build a personal favorites profile, group them into collections, track the dates that matter, and join groups so everyone can show up for each other better.

You must be at least 13 years old to create an account. By using Faves, you confirm that you meet this age requirement and that you have the legal capacity to enter into these Terms.

You're responsible for everything that happens through your account, including keeping your password secure. Please don't share your account with others, and let us know right away if you suspect unauthorized access at hello@thefaves.app.

You may close your account at any time from your account settings, or by emailing us.

Faves is built on what you share. We refer to your faves, lists, collections, notes, dates, and any other material you upload or create as your “Content.”

You own your Content.By posting Content to Faves, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that Content as needed to operate the Service (for example: showing it on your profile, in groups you've shared it with, or in emails we send on your behalf). This license ends when you delete the Content or close your account, except where we've already shared it with others (e.g., in groups) where they may have saved or referenced it.

You're responsible for your Content. Please don't post anything that:

• Infringes someone else's copyright, trademark, or other rights
• Is illegal, threatening, harassing, defamatory, or hateful
• Contains malware, viruses, or harmful code
• Impersonates someone else
• Violates anyone's privacy

We reserve the right to remove Content that violates these Terms or that we reasonably believe causes harm to other users.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or to our systems
• Scrape, copy, or otherwise extract data from the Service without permission
• Use the Service to send spam or unsolicited messages
• Interfere with or disrupt the Service or any servers, networks, or third-party services connected to Faves
• Reverse engineer, decompile, or attempt to derive the source code of the Service

The Faves name, logo, design, code, and all materials provided by us (other than your Content) belong to us. You may use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works of the Faves brand or interface without our written permission.

Your privacy matters. Our Privacy Policy explains what information we collect, how we use it, and your rights. By using Faves, you agree to the terms of the Privacy Policy.

We work hard to keep Faves available, but we don't guarantee that the Service will always be uninterrupted, secure, or error-free. We may change, suspend, or discontinue parts of the Service at any time, with or without notice.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, abuse the Service, or for any reason we believe is necessary to protect other users or our operations. We'll do our best to give you advance notice when possible.

When your account is terminated, your Content may be deleted, although some information may remain in backups for a limited time.

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We don't guarantee the accuracy, completeness, or usefulness of any Content posted by users. Any reliance you place on user-posted Content (including faves, gift suggestions, and links to third-party stores) is at your own risk.

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the Service will not exceed the lesser of (a) the amount you have paid us in the past 12 months, or (b) one hundred U.S. dollars ($100).

In no event will we be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill, even if we've been advised of the possibility of such damages.

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your Content, or your violation of these Terms.

If you believe content on Faves infringes your copyright, please email us at hello@thefaves.app with:

• A description of the copyrighted work you claim has been infringed
• The URL or location of the allegedly infringing material on Faves
• Your contact information
• A statement that you have a good-faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act on their behalf

Informal first. If you have a dispute with us, please contact us at hello@thefaves.appand we'll try to work it out together. Most disputes can be resolved with a friendly email. Both parties agree to attempt informal resolution for at least 30 days before formal proceedings.

Arbitration.If we can't resolve a dispute informally, both parties agree to resolve it through binding arbitration in Travis County, Texas, rather than in court. The arbitration will be conducted in English under the rules of the American Arbitration Association. You and we both waive any right to a jury trial and to participate in a class action.

Governing law. These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions.

We may update these Terms from time to time. If we make material changes, we'll notify you by email or by posting a notice in the Service before the changes take effect. Continued use of the Service after changes means you accept the updated Terms.
